Judgment Enforcement

So you have your judgment but the debtor is still not paying. You might be surprised to know that happens most of the time and, for that reason, a majority of judgment debts remain un-collected. But it does not have to be that way.

Haphazard enforcement can cost more than the amount collected. You need to have a practical plan of attack.  First you need to find targets for enforcement. Second you need to implement the legal processes required to attack those targets.  Usually real estate and employment are the best targets. However, other targetss can sometimes yield surprising results. We can help you figure this part out.

Once you have found your targets and decided on your plan of attack the process, like many court processes, can be slow, complicated and expensive. Maybe you do not want to spend any more money to collect from the debtor or you really do not want to wait any longer. In that case you could consider selling your judgment. However, be prepared you might not get any offers to buy it or the offer you do get might be just a few cents on the dollar.

Foreign judgments require some additional considerations but they can be enforced against the debtor here in British Columbia in the same way as local judgments.

We can review all of this with you. Give us a call before making a decision.
